New Bill Would Close Loophole Allowing Imported U.S. Flags on Federal Property

The Make American Flags in America Act of 2025 would ban imported flags from federal property.

It’s common sense that the U.S. flags waving before our U.S. government buildings should be Made in America. After all, what could be more patriotic than the Stars and Stripes flying on government property? The shocking truth is that the law prohibiting the federal purchase of entirely Made in USA flags is fairly recent and imported American flags linger. However, a new bill would ban all federal agencies from displaying U.S. flags that are not fully American-made.

The Make American Flags in America Act of 2025 builds on the All-American Flag Act enacted in 2024. The law requires federal agencies to exclusively purchase U.S. flags that are 100% Made in USA, from fabric to final stitch. Before the All-American Flag Act was passed, federally purchased U.S. flags were only required to contain 50% domestic materials, meaning that importers were able to pocket federal taxpayer dollars.

In addition to removing imported flags from U.S. agencies, the Make American Flags in America Act of 2025 would also charge the Federal Trade Commission with investigating the efficacy of current country-of-origin labeling fraud for U.S. flags and recommending appropriate deterrence.

Sens. Ted Cruz (R-Texas) introduced the bill in the Senate on March 7 with co-sponsors Sens. Thom Tillis (R-N.C.) and Rick Scott (R-Fla.), and Reps. Nick Langworthy (R-N.Y.) and Greg Landsman (D-Ohio) introduced the bill in the House the previous month.

“The American flag represents the pride and joy of being an American and the very values of a nation founded upon freedom, democracy and the American dream,” Scott said. “Producing an American flag is a privilege that should only be granted to our fellow Americans who believe in the values it represents, not nations like Communist China who seek to destroy the American way of life. Our bill preserves and protects the pride of American-made products and the patriotism of the flag and nation we love.”

“This is a no-brainer: American flags should be made in America,” said Langworthy. “Our flag is a symbol of democracy, power, and glory. The best way to honor these principles is to make sure our nation’s economy and American manufacturers benefit from it.”
